Experts suggest Trump is replacing his lawyer due to her perceived lack of expertise

Following Trump’s Truth Social post, many began speculating that the former president is looking for a new lawyer. Ty Cobb, ex-White House lawyer, and legal analyst Elie Honig shared their thoughts on Alina Habba and why they think the GOP’s likely presidential nominee is looking for another representation. 

Cobb’s assessment

On CNN’s “Erin Burnett OutFront, Cobb said, “She’s done his bidding. She’s articulated his political narrative of victimization and unfairness in the judicial system and made some outlandish claims, including the conflict claims.”

The news came after the defamation case

Cobb continued, “She lost, so she’s a loser. I’m not surprised that Trump is looking for appellate representation.” The news about Habba’s potential replacement came days after Trump was ordered to pay over 83 million dollars in a defamation suit brought on by E. Jean Carroll.

Burnett asked, “What do you think about how she’s handled the case?” Cobb replied, “I think she’s handled it in the mafia way.” The news of a potential replacement search comes less than a month after Joe Tacopina and his team withdrew from Trump’s other New York cases.

CNN’s legal analyst told the host Jake Tapper that Habba “had zero client control,” adding, “I don’t know who can control this client, but allowing him to walk out during the other side’s closing arguments, that is inexcusable and that is reflected in the huge verdict that they got hit with.”

The legal expert continued talking about Habba, “She does not know what she’s doing. She cannot even do things that you learn in evidence class, not violate the rules of hearsay.”

“I am in the process, along with my team, of interviewing various law firms to represent me in an Appeal of one of the most ridiculous and unfair Witch Hunts our Country has ever seen—The defamation Sham presided over by a Clinton appointed, highly partisan, Trump Hating Judge, Lewis Kaplan, who was, together with certain other Radical Left Democrat Judges, one of the most partisan and out of control activists that I have ever appeared before,” the former president wrote.

Habba was blasted after presenting an argument that Carroll’s case should be tossed because a New York Post article reported Carroll’s lawyer, Roberta Kaplan, previously worked at the same firm as Judge Lewis Kaplan. This was in the early 90s. Honig stated, “This is a bogus motion by the Trump team.” 

Everyone’s connected

Honig continued, “Every judge in that courthouse knows, socializes with, has worked with, sometimes maybe mentored, dozens, hundreds of attorneys in this city.” He was joined by other lawyers, who shared Honig’s sentiments. 

It’s not 1992

Andrew Fleischman wrote on X, “Judge Kaplan would have a real conflict of interest if E. Jean Carroll were suing Donald Trump in 1992, and then the lawsuit languished for 32 years, and one of the original lawyers who filed that suit was still with the firm.” Carroll first filed the lawsuit in 2019.

Former New York and federal prosecutor Daniel Alonso wrote on X, “God, this is nonsense. Plus, a lawyer would have to be an idiot not to know that the Judge and Ms. Kaplan were at the same firm. Knock it off!” 

Trump’s used to replacing lawyers

Speaking to Newsweek, former federal prosecutor Neama Rahmani shared, “Trump goes through lawyers like his daily Diet Cokes,” adding, “First, Trump has a reputation for not paying his lawyers. And he is so toxic to half the population that lawyers risk losing other business when they accept him as a client.”

Vance joined in

Former federal attorney Joyce Vance wrote in her blog, Civil Discourse, “It’s shocking that a former president is represented by a lawyer who doesn’t seem to know her way around a courtroom and continues to antagonize the Judge by violating his pre-trial rulings, especially since the lawyer on the other side is Roberta Kaplan (no relationship to the Judge), an A++ caliber lawyer.”
