Trump’s Many Recent Victories Are Warning Signs For Democracy

Thursday was a great day for the former president. His four victories, however, signal the rising threat to democracy, political commentators warned.

On Thursday, Trump won over 99% of the vote in Nevada’s primary caucus. On Tuesday, the state held a non-binding primary, in which Nikki Haley embarrassingly lost to “none of these candidates.”

Also on Thursday, Special Counsel Robert Hur released a 388-page report concluding that Biden “wilfully” kept classified materials in his home — but shouldn’t face criminal charges due in large part to his age. 

Not remembering

In interviews with Hur, Biden reportedly could not remember “even within several years” when his son died. He also couldn’t remember exactly when he was vice president.

Making Trump’s case

On Thursday, Trump’s legal team presented its arguments to the Supreme Court, which seemed to lean towards allowing the former president to remain on the ballot. Chief Justice John Roberts warned that allowing states to disqualify presidential candidates would prompt Republicans to try and bar Democratic candidates from running.

“In very quick order, I would expect … that a goodly number of states will say whoever the Democratic candidate is, you’re off the ballot,” Roberts argued. “It will come down to a handful of states that will determine the presidential election.”

“As a legal proposition,” The Nation argued, “the court shouldn’t be deciding cases based on what it thinks bad-faith politicians will do with its decisions.” While the liberal judges generally also seemed convinced by Trump’s team, Justice Sonia Sotomayor criticized the team’s argument as “a bit of a gerrymandered rule designed only to benefit your client.”

Dubious argument

Trump’s legal team argued that even if Jan 6 was an insurrection, only Congress could decide to remove him, and only after he had been elected. However, that would mean the vote being controlled by the GOP, which is currently pushing for a resolution claiming that Trump “did not engage in insurrection.”

Meanwhile, Special Counsel Jack Smith has been battling with Judge Aileen Cannon, accusing her of causing “significant risks of threats” to witnesses in the classified documents case against Trump.

Keeping things wrapped

Cannon has refused to allow Smith’s team to keep information about the witnesses classified. Smith has argued that the federal government is investigating threats made against these witnesses, and that releasing information about them would impact the ongoing investigation.

In September, Judge Tanya Chutkan allowed Smith’s team to keep evidence classified after prosecutors argued that Trump had threatened individuals related to the case. Chutkan herself was the target of a death threat sent by a Trump supporter just one day after he posted, “IF YOU GO AFTER ME, I’M COMING AFTER YOU!” on Truth Social.

In January, Slate accused Judge Cannon of “quietly sabotaging the Trump classified documents case.” A “mountain of evidence,” the article alleged, demonstrated that Cannon “is firmly in the former president’s pocket.”

Smith’s team argued that Trump is using the public humiliation and harassment of witnesses and officials “to his advantage” in courts and on the campaign trail. “It has continued unabated as this case and other unrelated cases involving the defendant have progressed,” the Justice Department argued last year.

“This is likely the pace for the rest of 2024,” Alex Woodward wrote in the Independent. “An exhausting blast of ‘flood the zone’ chaos to prove Mr Trump ‘right’ at everyone else’s expense.”
