The Governor of Texas wrote on X, “Texas has transported over 102,000 migrants to sanctuary cities. Overwhelmed Texas border towns should not bear the brunt of Biden’s open border policies. Our transportation mission will continue until Biden secures the border.”

Ignoring the SCOTUS’ ruling

The Supreme Court ordered Texas to allow the Border Patrol to remove concertina wire. But Abbott declared Texas is placing more razor wire along the banks after the SCOTUS’s 5:4 ruling. Some Republicans praised Abbott’s decision.

“I have already declared an invasion under Article I, $ 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary,” Abbott’s statement read.

The Texas Governor wrote on January 23, “This is not over. Texas’ razor wire is an effective deterrent to the illegal crossings Biden encourages. I will continue to defend Texas’ constitutional authority to secure the border and prevent the Biden Admin from destroying our property.”

Following Abbott’s statement, Speaker Jonhson wrote on X that the Republican-controlled House of Representatives “will do everything in its power to back him up.”  On Fox News, South Dakota Governor Kristi Noem said, “I will drive razor wire to Governor Abbott for him to do his job.” Among others who backed Abbott are Virginia Governor Glenn Youngkin, Florida Governor Ron DeSantis (R), Oklahoma Governor Kevin Stitt, and Georgia Governor Brian Kemp.

Abbott told Fox News’s Sean Hannity on Monday, January 29, “This is the No. 1 issue in America. Americans want a secure border. If Joe Biden federalizes our National Guard, that would be the biggest political blunder that you can make, and that’s why I think he will not do it.”

Abbott continued, ” I am prepared in the event that they do make such a blunder to make sure that Texas will be able to continue to secure our border.”

“Texas will be vindicated”

“Texas has every constitutional right in this case, and I believe, when the sun sets on this, Texas will be vindicated, and the Constitution will be strengthened,” Abbott concluded.

The Houston Chronicle’s editorial board wrote, “Abbott, a former Texas Supreme Court justice, apparently thinks he knows better than the highest court in the nation what the U.S. Constitution says.”

“He’ll earn a place in the history books right next to Governor George Wallace in the schoolhouse door, promising to block integration in defiance of the Supreme Court’s ban on school segregation,” the editorial board wrote of Abbott, and concluded, “We can think of better legacies for a man who has the brains and education to know better.”

No invasion

Immigration attorney and policy strategist Aaron Reichlin-Meln commented on Abbott’s actions, “This is, to be blunt, hogwash. Article I, Section 10 of the Constitution does not give Texas a right to carry out immigration law. Here’s what it says. Texas is not ‘actually invaded’ and laying razor wire is not ‘engaging in war’ — which anyone with two brain cells can see.”

Attorney Raymond J. Mollica shared on X, “Your dissatisfaction (or, more to the point, politically based contrivances) do not, in any way, confer upon the State of Texas the power to usurp Federal Authority, and the policing of the Border is solely under the jurisdiction of the US Government.”
