Colorado Republican Ken Buck revealed a resolution calling on VP Harris to invoke the 25th Amendment to remove President Joe Biden from office. The move comes as a surprise, considering that Buck was against impeachment and even criticized some House Republicans over lack of evidence.
Buck cited Hur’s report
The GOP House member cited special counsel Robert Hur’s damning 388-page report, which cleared Biden of any criminal charges but brought into question his mental state. Hur’s report described Biden as a “sympathetic, well-meaning, elderly man with a poor memory.”
Buck’s statement
In the official statement posted on February 26, the Colorado Republican, who is not running for re-election, shared, “Numerous instances were articulated in the report and have played out in full public view, showing President Biden’s apparent cognitive decline and lack of mental stamina.”
Calls to invoke 25th Amendment
Buck’s press release continued, “The societal challenges and security threats our country faces are innumerable and require a chief executive with both strong mental and physical faculties. The time has come for the vice president and the Cabinet to put our country first and move forward on invoking the 25th Amendment.”
Buck opposed Republican efforts to impeach Biden
In December 2023, Buck caved and joined House Republicans in formalizing the impeachment probe. However, he also stated that his party was “relying on an imagined history” and more recently opened up about the former FBI informant who was supposed to be the GOP’s star witness.
Buck confirmed GOP was “warned” about the witness’s credibility
Talking to CNN, Buck said, “We were warned at the time that we received the document outlining this witness’s testimony.” He added, “Yet, people, my colleagues went out and talked to the public about how this was credible and how it was damning and how it proved President Biden’s — at the time Vice President Biden’s — complicity in receiving bribes.”
The Colorado Republican voted against Mayorkas’ impeachment
Buck, who spent over 25 years working as a lawyer, was among three GOP House members who voted against the impeachment of Homeland Security Secretary Alejandro Mayorkas. The House impeached him in a 214-213 vote.

Buck shared on X, “President Biden has proven that he is no longer fit for office. His cognitive decline and lack of mental stamina has been both public and undeniable. I call on Biden’s Cabinet to constitutionally remove him from office, using the 25th Amendment.”
The 25th Amendment was adopted in 1967
The 25th Amendment was adopted following the death of President John F. Kennedy in 1963. It sets succession rules relating to vacancies and disabilities in the office of the President or Vice President. Essentially, it is used to replace the president in the event of death, removal, resignation, or incapacitation.
VP and Congress can use the 25th Amendment
The Amendment further states that “whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide … their written declaration that the President is unable to discharge the powers and duties of his office.”
Another representative also tried to use the 25th Amendment
Claudia Tenney, a New York Republican, called on Attorney General Merrick Garland to invoke the 25th Amendment and remove the President after Hur’s report. In mid-February, she wrote to Garland about her “grave concerns.” However, she referred to Hur’s reasons for not bringing charges against Biden, despite the president “knowingly and willfully removed, mishandled, and disclosed classified documents.”
Tenney criticized the outcome
In a letter, the House Republican wrote, “We don’t prosecute or decline to prosecute people based on their personalities or on the public’s anticipated perception of them.” She added, “If Special Counsel finds that the evidence forms a reasonable basis to bring charges, he must do so.”
The vast majority of voters are concerned about Biden’s age
Biden, the oldest president in history, faced harsh criticism from Republicans, as well as from the voters. The 81-year-old’s age is a concern for 86% of voters, who said he was too old to serve another term, an ABC News/Ipsos poll found.
Historical move
If Kamala Harris, with the help of Congress’s majority, invoked the 25th Amendment, it would be a historical move since no VP has ever invoked these powers.
