Fani Willis’s impeachment progresses, but the DA will not recuse herself from the Trump case 

Fulton County District Attorney Fani Willis is closer to being impeached, but according to CNN’s sources, she has no intention of refusing herself. Georgia Senate created a special committee with subpoena power to investigate Willis following allegations brought on by one of Trump’s co-defendants. 

Georgia Senate’s approval

On January 26, the state Senate voted to create a special committee that GOP senators claim is needed to determine whether the Democratic DA misappropriated state tax money in prosecuting former President Trump and 18 others. This committee does not require approval from the state House or Georgia Governor Brian Kemp.

It started with affair allegations

One of the co-defendants, Michael Roman, a former White House aide, alleged that Willis and prosecutor Nathan Wade had a “romantic relationship.” Roman’s attorney filed a motion stating that Willis and the prosecutor have been “profiting significantly from this prosecution at the expense of taxpayers.”

Wade’s alleged “lack of relevant experience”

The filing cited Wade’s “lack of relevant experience,” adding that the two traveled on vacations together and “co-habited in some form or fashion.” According to Wade’s divorce filings, Willis traveled with him to Miami and San Francisco.

Republican State Senator Brandon Beach accused of employing Wade “for personal profit scheme” and added, “I believe this scheme — prosecution for personal profit — was a fraud against the court, and it was a fraud against you as a Georgia taxpayer.”

Wade reportedly got over 600k

County records seen by The Hill show Wade was paid $ 654,000 in legal fees from 2022 to 2023 related to the Trump case. Willis responded by suggesting, “They only attack one. I hired one white woman: a good personal friend and great lawyer, a superstar, I tell you. I hired one white man: brilliant, my friend, and a great lawyer. And I hired one Black man, another superstar, a great friend, and a great lawyer.”

The panel will have nine members, at least three Democrats. According to Senator Greg Dolezal, a Republican, “The powers and duties of this committee are limited in scope to address the questions and allegations and potential remedies as it relates to either state appropriations of funds or potential law changes that may come about as the Senate study committee conducts its work.”

Senator Moore shared his thoughts

After the voting on the resolution, Senator Colton Moore shared on X a quote, “First they ignore you, then they laugh at you, then they fight you, then you win,” adding, “The Georgia grassroots stood by me while the GOP establishment, the corrupt Democrats, and the elites in power all mocked us for our effort to INVESTIGATE FANI WILLIS.”

Moore further shared, “The people ran a pressure campaign that I was blessed to lead, and today… we see what REAL COURAGE can deliver.”

Moore continued, “Investigating Fani Willis is the first step towards impeaching and defunding this corrupt prosecutor. We cannot let up the pressure now… we must DOUBLE DOWN.

“We are just getting started. We will save America. But it will take enormous courage and participation from grassroots, blue-collar PATRIOTS from across the land of the free,” the Senator concluded. 

Even if Willis did nothing wrong, the case will be delayed

Andrew Fleischman, an Atlanta defense attorney, told Salon that the case would be significantly delayed even if no conflict of interest were found. If a conflict of interest is found, Willis and her office will be disqualified.

Roman is asking for Willis to be disqualified, and attorney and legal analyst Phil Holloway told Fox News, “If it can be proven she violated the Constitution in the way of substitute due process claims, that she was fundamentally unfair in how she carried out her prosecutorial duties, then that could result in a dismissal.”

Former federal prosecutor on the rules

Ex-federal prosecutor Jennifer Rodgers said on CNN’s News Central, “The rules are that if she steps aside, her whole office is recused, and if they take that office off of this case, there’s a commission that would then look to try to appoint another prosecutor’s office,” adding, “I think if she steps aside, this is effectively over.” CNN reported Willis won’t recuse herself.
