On Thursday, legal analyst and ex-federal prosecutor Glenn Kirschner pointed out that Donald Trump may have incriminated himself with a recent post on Truth Social concerning his federal election interference case.
A Truth Social Slip?
Kirschner, an outspoken critic and former assistant U.S. attorney, argued in a YouTube video Trump’s own words on Truth Social as potential evidence of guilt. He sees it as potentially crucial for Jack Smith’s DOJ case on federal election interference.
Trump’s Immunity Plea
Trump stated in a Thursday post, “A president of the United States must have full immunity, without which it would be impossible for him/her to properly function. Any mistake, even if well intended, would be met with almost certain indictment by the opposing party at term-end. Even events that ‘cross the line’ must fall under total immunity, or it will be years of trauma trying to determine good from bad…”
Indirect Confession?
Kirschner interprets this as an indirect admission by Trump, particularly his call for personal immunity and Trump’s typical disregard for anyone else’s situation. “That’s what I’d refer to as a tacit admission or an implied admission, but you really don’t have to read between the lines,” he said.
Legal Analysis
Kirschner continued, “This is Donald Trump demanding immunity for himself since when is he ever concerned about what happens to others, other presidents, for example? He wants immunity for himself, even when events cross the line.”
Total Entitlement?
As an NBC News and MSNBC legal analyst, Kirschner interpreted Trump’s words as him saying, “I’m entitled to total immunity. I’m entitled to be permitted to commit these crimes. These crimes must be tolerated. These crimes must be excused.”
‘Trump can’t help himself’
“It doesn’t look like Donald Trump is going to stop providing confessions, admissions, incriminating statements to Jack Smith anytime soon. And trust me, friends, Jack Smith’s team of federal prosecutors is cataloging every word, every sentence, every post because Donald Trump can’t help himself,” Kirschner argued.
Easier to Prove Trump’s Guilt?
Speaking to Newsweek, Glenn Kirschner shared his view on Trump’s strategy via text. He believes Trump thinks that openly admitting his actions casts doubt on his criminal intent, a crucial aspect of proving guilt.
Self-Admission Risks
Kirschner’s take is, “If he’s openly admitting it, he must not think it’s criminal. He must not think he’s doing anything wrong.” However, he argues that this tactic actually makes proving Trump’s guilt, including his criminal intent, more straightforward.
A Call for Quick Verdict
Kirschner also expressed frustration at the U.S. government’s apparent hesitation to pursue accountability for Trump, saying, “Trump is right to believe that he can not only commit crimes but can also admit to crimes, and the institutions of government will STILL hesitate to hold him accountable.”
Bias in Law Enforcement?
“Hell, it’s worked for him thus far, hasn’t it? Our law enforcement agencies and institutions do a lousy job of holding accountable the ruling class criminals – people of wealth, power, influence, connections,” he continued.
Trump Campaign Responds
On the other hand, a spokesperson for Trump’s campaign criticized Kirschner in an email to Newsweek, writing, “Glenn is a notorious trafficker of wild conspiracy theories and dubious legal analysis. I would expect nothing more from a clout-chasing MSNBC contributor who has been shunned by the legal community at large.”
January 6th Aftermath
Back in August, Trump faced indictment by the DOJ on four counts, including conspiracy to defraud the U.S., related to the January 6, 2021, Capitol riot. The event unfolded when Trump’s supporters stormed the U.S. Capitol in Washington D.C. to disrupt the confirmation of Biden’s election victory, backed by Trump’s baseless claims of a stolen election.
Trump Leads GOP Despite Charges
Trump, who has consistently denied involvement in the insurrection and pleaded not guilty to all charges, is leading the 2024 GOP presidential primary race. He views the case as politically motivated, while he and his attorneys argue for presidential immunity since he was still in office during the riot.

In Monday’s Iowa caucuses, former President Donald Trump set a new record for Republican presidential candidates, winning by a significant margin and highlighting his widespread support at the outset of the 2024 nominating race.
