Constitutional Scholar Lauren Tribe Claims That Trump “Let The Cat Out Of The Bag”

Laurence Tribe, a legal expert and Professor Emeritus at Harvard University, commented on Trump’s request to delay the D.C. trial, claiming that with this move, he “admits he’ll be found guilty beyond a reasonable doubt!”

Laurence Tribe, a legal expert, wrote on X, “In the reply urging SCOTUS to delay his D.C. criminal trial, Trump let the cat out of the bag. He said Jack Smith wants to finish the trial before November because the verdict will obviously hurt Trump’s chances. Really? That admits he’ll be found guilty beyond a reasonable doubt!”

Jack Smith urged SCOTUS to deny Trump’s request

Trump’s request to pause the D.C. trial was met with a filing by Jack Smith’s office that notes the “nation has a compelling interest in the prompt resolution of this case.” Smith urged the SCOTUS to deny Trump’s request, stating, “The charged crimes strike at the heart of our democracy.”

Rubin, the MSNBC legal correspondent, said that Trump’s request claims “Smith’s sole reason to insist on a speedy trial would be to ruin Trump’s candidacy.” But, she presented another side, writing, “What if the special counsel simply thinks Trump should be tried” to give voters all the information because Trump cannot escape the trial even if re-elected.

In early February, a three-judge panel for the U.S. Circuit Court of Appeals for D.C. ruled that presidential immunity claims could not apply to Trump because he is no longer a president.

“For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant.” the justices wrote in the verdict. 

Open to civil lawsuits

Trump’s legal team filed an appeal to the Supreme Court, though they have decided against appealing a decision that found he is not immune from civil lawsuits that blame him for the January 6 attack on the Capitol.

“President Trump will continue to fight for presidential immunity all across the spectrum,” said Steven Cheung, a Trump spokesman, in a statement to NBC News. Still, according to Politico, Trump’s allies said the former president was “leaving the door open to revisiting a challenge to the ruling later in the process.”

Elie Honig on whether SCOTUS will hear out Trump’s legal team

Honig, the former federal prosecutor, told CNN there is no way to tell when we will hear from the Supreme Court. But will they take Trump’s case? Honig reminded that “it takes five justices to take the pause in the district court, but it only takes four justices to actually grant certiorari, to actually take the case and rule on it.” 

“Close call”

Honig suggested that would be a “close call” because three liberal justices would not want to take this case. He also indicated that justices Alito and Thomas would be pro-taking the case, so “if they get two more justices, then they will take this case, and it will cause some delay.”

The 26 former U.S. Department of Justice attorneys, lawmakers, and others who served as Republicans warned of “terrifying possibilities” if the immunity claims stand. They wrote, “Under former President Trump’s view of absolute immunity, future first-term Presidents would be encouraged to violate federal criminal statutes by employing the military and armed federal agents to remain in power.”

The brief continued, “No Court should create a presidential immunity from federal criminal prosecution, even for official acts, that is so vast that it endangers the peaceful transfer of executive power that our Constitution mandates.” They added that the absolute immunity argument “finds no support” in the Constitution.

While on MSNBC, the legal scholar said, “I don’t expect that the US SuprU.S.Court will grant his stay,” He added, “There’s really no basis for it. It’s simply a delaying tactic. And I also don’t think there’s a good reason for the U.S. Supreme Court to grant review of the case.”

But the New York hush money trial is about to start

The D.C. election interference trial, which was supposed to begin on March 4, is now on hold. This means that the first criminal trial against the former president should start on March 25. Judge Juan Merchan confirmed that he would move on to the jury selection and estimated the trial would be done in six weeks.
