Alina Habba Takes Offense After Fox Host Cited That Trump’s Appeal Won’t Work

Former US President Donald Trump's lawyer, Alina Habba (front), leaves Trump Tower for Manhattan federal court for the second defamation trial against him, in New York City on January 17, 2024. Writer E. Jean Carroll is seeking more than $10 million in damages in the civil trial, alleging that Trump defamed her in 2019 when he was president and she had just come out with her allegation, saying she "is not my type." This is separate to a civil case last year where another New York jury found Trump liable for sexually assaulting Carroll in a department store dressing room in 1996 and subsequently defaming her in 2022, when he called her a "complete con job." Alina Habba, Trump’s lawyer and legal spokesperson, was Fox News Channel’s The Story with Martha MacCallum, and even a mere suggestion that an appeal in the fraud case won’t work triggered a feisty reaction.

MacCallum read lawyer Andrew McCarthy’s op-ed from the National Review, where he stated. “I think it is unlikely that Trump’s appeal will result in a clean win for either side.” Habba, an attorney for Trump in the E. Jean Carroll case and NYC fraud case, fired back swiftly.

Habba had a message for the lawyer, saying she would “welcome him to be part of the legal team if he knows the case better than the team that tried it for 11 weeks.” She continued, “I’ve been on this case for the better of three years, and I can tell you right now there are truly no facts that support any of these decisions, and that, again, I can say will be made very clear in our appeal.”

The Republican attorney wrote that while he believes that Trump could get monetary relief in the fraud case, “I wouldn’t hold my breath on the rest of the penalties. And those penalties matter a lot.” Trump was ordered to pay $354.9 million in penalties after he was found liable for business fraud.

The lawyer believes the case was “nakedly partisan”

In his piece, McCarthy asserted the case was “nakedly partisan” and added that his hopes were that Trump would get “overturned on appeal.” Judge Engoron rejected the idea that the case against Trump was politically motivated.

Habba was asked about the options and any potential “Hail Mary pass” in the fraud case, to which Trump’s attorney stated, “I will never show my cards, Martha. You know I’m too good to do that!”

She added, “I will tell you that we have a great team. I’m proud of our team. And we’re working around the clock to figure out what strategically is the best move.”

Habba went after Attorney General Letitia James, “One thing I can tell you is that her goal of tearing down the Trump Organization, her goal of tearing down the individuals that worked so hard, including on his campaign, his family, and the list goes on and on. Her goal is not going to succeed. “

Habba further noted, “Martha, all I can say is this: President Trump is one of the smartest businessmen, one of the greatest presidents we have ever seen.” She continued, “This is all political. There’s actually no factual basis to it. And I’m really looking forward to everybody seeing our record on appeal.”

Trump’s sons, Eric and Don Jr., were ordered to $4 million each. The Trump Organization and two firm executives, Allen Weisselberg and Jeff McConney, according to AG James, claimed they overstated the values of assets to deceive financial institutions.

James told ABC News she is willing to seize Trump’s assets if he does not pay almost $350 million. But Habba assured Fox viewers that won’t happen and added, “They’ve done nothing wrong. There were no victims, and everyone made money.”

Habba continued by sharing that James’ goal was “to try and hurt the president, try and hurt his family, the company.” Meanwhile, Trump also discussed the case in a Fox town hall meeting in South Carolina.

“‘I have a lot of cash”

During a town hall meeting, Trump stated, “‘I have a lot of cash, but that doesn’t mean he can take it,” while referring to Judge Engoron. The former president added, “I think he looked at my cash, and he said, ‘We’ll take all of his cash,'”
