The report from the special counselor, published on Thursday, determined that no charges should be filed against the president. However, it highlighted concerns regarding Biden’s memory and recall abilities.
Biden’s Electability Concerns
On CNN’s “Newsnight,” Jennings expressed skepticism about President Biden’s capacity to serve another term.
“There aren’t too many Americans… who are going to look at this and say, ‘This guy is up to serving for five more years as president of the United States,'” he remarked.
Harris Importance
Jennings emphasized the increasing importance of Vice President Harris in the electoral landscape.
He said, “I think Vice President Harris became, squarely, an issue in this election today. She already was getting there, and now, it’s even more important.”
Approval Ratings
Vice President Harris’s approval ratings have shown variability, with a Los Angeles Times tracker indicating a 40% favorability in late January, contrasting with a 31% approval in an NBC poll recorded last summer.
Confusion in Interviews
As per Hur’s report, during interviews with investigators, Biden became confused regarding the timeline of his vice presidency and even struggled to recall the year of his son Beau’s passing.
“Man with a Poor Memory”
One of the factors influencing the investigator’s decision not to pursue charges was the likelihood that “at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.”
Sympathy for Biden
The report notes that his “diminished faculties in advancing age” would probably garner sympathy from jurors.
No Memory
It stated, “He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (‘if it was 2013 – when did I stop being Vice President?’), and forgetting on the second day of the interview when his term began (‘in 2009, am I still Vice President?’),”
Unclear on Troop Withdrawal
According to the report, Biden also appeared to be unclear about the debate surrounding the withdrawal of troops from Afghanistan, a pivotal aspect of the early months of his presidency.
Documents Storage
The report noted, “We also expect many jurors to be struck by the place where the Afghanistan documents were ultimately found in Mr. Biden’s Delaware home: in a badly damaged box in the garage, near a collapsed dog crate, a dog bed, a Zappos box, an empty bucket, a broken lamp wrapped with duct tape, potting soil, and synthetic firewood.”
Doubts Over Performance Ability
With the release of this report, questions regarding Biden’s ability to effectively perform his duties, especially if he were to win a second term, begin to grow louder, particularly from the conservatives, given his status as the oldest president in U.S. history.

Biden responded to the report with a fiery press conference on Thursday night, staunchly defending his memory and mental acuity.

The president said, “I’ve seen the headlines since the report was released about my willful retention of documents. These assertions are not only just misleading, they’re just plain wrong,”
“My Memory’s Fine”
He added, “My memory’s fine. … Take a look at what I’ve done since I became president. … How did that happen? I guess I just forgot what was going on.”
Case Against Trump
Biden aimed to distinguish himself from former President Donald Trump, 77, who is confronting 40 criminal charges for refusing to surrender classified documents after he departs from the White House in 2021.
Political Bias
Trump, slated to stand trial starting May 20 in South Florida, claimed on Thursday that Hur’s recommendation against filing charges against Biden reveals political bias within the Justice Department.
“I did Nothing Wrong”
Trump said, “The Biden Documents Case is 100 times different and more severe than mine. I did nothing wrong, and I cooperated far more. What Biden did is outrageously criminal – He had 50 years of documents, 50 times more than I had, and ‘WILLFULLY RETAINED’ them.”
