Trump Appeals Hefty $454 Million Judgment in New York Civil Fraud Case

Donald Trump has challenged a judicial decision that obliges the former U.S. president to pay $454 million for reportedly inflating his net worth and property values to obtain favorable loan conditions.

On Monday, Trump appealed to a state appellate court, seeking to reverse Justice Arthur Engoron’s February 16 verdict in a 2022 civil fraud case initiated by New York Attorney General Letitia James.

Errors in Law?

Trump’s legal team, in their court filings, have urged the appeals court to examine whether Justice Arthur Engoron “committed errors of law and/or fact” or overstepped his authority or discretion. 

Financial Misconduct

Engoron concluded that Trump, along with his organization and key executives including his sons Eric and Donald Trump Jr., had engaged in a long-term deception of banks and insurers by exaggerating his financial worth for loans and deals. 

The judge imposed severe restrictions on the Trump Organization’s business operations.

This appeal means that the dispute regarding Trump’s business tactics will continue well into the presidential primary season and possibly longer, as he aims to secure the Republican presidential nomination and reclaim the presidency.

If Justice Arthur Engoron’s decision stands, it will significantly impact Donald Trump’s finances, compelling him to part with a substantial portion of his wealth. Engoron has ordered Trump to pay $355 million in fines, which, with added interest, now amounts to almost $454 million.

This sum grows by approximately $112,000 daily until paid.

Trump, who claims to be worth several billion dollars and stated last year he had about $400 million in liquid assets, along with properties and investments, faces potential asset seizure by Attorney General Letitia James, a Democrat, if he fails to pay.

Trump’s decision to appeal, which he had pledged to do, comes as no surprise. He has criticized Engoron’s ruling – the most financially damaging of his recent legal issues – as “election interference” and a “weaponization against a political opponent,” lamenting the penalty for what he describes as building a “perfect company” with “great cash, great buildings, great everything.”

Confident in Overturning Verdict

Christopher Kise, Trump’s lawyer, expressed confidence post-verdict that the appeals court will correct what he described as numerous and significant errors made by a trial court that was “untethered to the law or to reality.”

Legal Stakes High for Trump

Trump’s legal team, including Alina Habba, views this verdict as extreme and believes it could send a discouraging message to businesses in New York if it stands. Habba anticipates the Appellate Division will overturn this verdict, seeing it as unjust persecution against Trump. 

Suspension of Ruling

The Appellate Division, First Department, has the authority to temporarily suspend Justice Arthur Engoron’s ruling while Trump’s appeal is under consideration, a process that could extend over a year or more.

The appeal is likely to focus on allegations of bias against Justice Engoron and legal issues in the lawsuit filed by James. 

Legal Limits Tested

Trump’s legal team has already challenged several of Engoron’s decisions and contends that some allegations are time-barred, arguing that Engoron did not adhere to an earlier Appellate Division directive to limit the trial’s scope.

Engoron’s decision came after a challenging three-month trial in Manhattan, which began in October and included Trump’s admission that his property valuations weren’t always precise, though he noted his lenders were expected to independently confirm them.
