Texas Governor Greg Abbott declared on Monday that the Supreme Court’s decision is far from concluding Texas’s efforts to fortify the Rio Grande banks with concertina wire, aimed at curbing illegal immigration.
Border Injunction Lifted
The court, in a narrow 5-4 verdict, overturned a lower court injunction that had stopped Border Patrol agents from interfering with the wire. This injunction was set to remain until a lawsuit regarding the wire’s placement at the border was adjudicated.
A Supreme Decision
The court’s brief declaration stated, “The application to vacate injunction presented to Justice Alito and by him referred to the Court is granted. The December 19, 2023 order of the United States Court of Appeals for the Fifth Circuit, case No. 23-50869, is vacated. Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh would deny the application to vacate injunction.”
Border Fight Far from Over
Abbott emphasized that the injunction and the underlying lawsuit are separate matters, asserting in a Monday X post, “This is not over. Texas’ razor wire is an effective deterrent to the illegal crossings Biden encourages. I will continue to defend Texas’ constitutional authority to secure the border and prevent the Biden Admin from destroying our property.”
Abbott’s Border Vision
Governor Greg Abbott of Texas also supported a statement from Texas Department of Public Safety’s Lt. Chris Olivarez, who wrote, “The State of Texas, under Gov. @GregAbbott_TX’s Operation Lone Star, will maintain its current posture in deterring illegal border crossings by utilizing effective border security measures – reinforced concertina wire & anti-climb barriers along the Rio Grande.”
Federal Border Policy Questioned
Olivarez continued, “The logical concern should be why the Federal Government continues to hinder Texas’ ability to protect its border, all while allowing for the exploitation, dangerous, & inhumane methods of permitting illegal immigrants, including children, to illegally cross a dangerous river where many have lost their lives.”
Against Illegal Immigration
“Texas is the only state using every strategy & resource to protect its sovereignty, combat criminal activity, & discourage illegal immigration,” Olivarez asserted “#Texas will continue to hold the line.”
A ‘Correct’ Conservative Insight
Governor Abbott concurred with Jack Posobiec, a conservative commentator, who provided insight into the recent Supreme Court ruling concerning the ongoing legal battle over razor wire on the Texas border. Abbott agreed with Posobiec’s assessment, calling it ‘correct.’
Case Still in Play
“To be clear, the Supreme Court ruling today was specifically about the court order on cutting razor wire The 5th Circuit still needs to hear the actual case on its merits There is still a chance Texas wins,” Posobiec wrote.
Border Wire Battle
Politico reports that in October, Texas sued the federal government to stop agents from cutting or removing the wire. As the lawsuit progresses through the appeals process, Texas has secured an injunction that temporarily prevents federal agents from interfering with the wire.
Border Security Dynamics
Speaking with CNN, the head of U.S. Customs and Border Protection (CBP), Acting Commissioner Troy Miller, discussed the implications of the Supreme Court’s ruling on border security.
‘No Timetable’ for Wire Removal
Miller stated that the decision “allows us to have access to the border so we can begin to gain access like we did before,” while also acknowledging that “the rest of the case is still under active litigation.” He mentioned there is “no timetable” for removing the razor wire.
Ready for ‘Swift’ Border Action
A law enforcement source informed CNN that federal CBP agents are prepared to ‘swiftly’ cut through the fencing for life-saving actions or critical operational needs. The source explained that agents would quickly breach the fencing to provide aid to anyone in distress or for reasons deemed ‘operationally necessary.’
A Direct Order
When asked about CBP’s authority to cut through the razor wire amid the ongoing legal dispute, the source emphasized, “This goes far beyond ‘reserving the right’. The U.S. Supreme Court has ordered it.”
