SCOTUS Shuts Down Biden Admin’s Abortion Mandate for ER Doctors in Idaho

The Supreme Court has given the green light for Idaho’s abortion ban to be enforced and will also consider a dispute about the Biden administration’s interpretation of the EMTALA.

The administration asserts that EMTALA mandates emergency room doctors to carry out abortions. Idaho disputes this, arguing that EMTALA does not explicitly mention abortion and that their law is consistent with the act’s intent to save lives.

This development comes as the U.S. Court of Appeals for the Fifth Circuit previously blocked the HHS EMTALA guidance in Texas, sparking criticism from President Biden and endorsement from Idaho’s Attorney General.

The brief points out that EMTALA’s scope is broader than the Idaho law, covering not just life-threatening situations but also emergencies that “seriously threaten their health.”

“Idaho law thus criminalizes care required by federal law: Under Section 18-622, an emergency room physician who concludes that a pregnant woman needs an abortion to stabilize a condition that would otherwise threaten serious and irreversible harm may not provide the necessary care unless and until the patient’s condition deteriorates to the point where an abortion is needed to save her life,” the brief reads.

Interpreting EMTALA

Judge Kurt Engelhardt stated in his opinion that EMTALA doesn’t require any particular medical treatment, including abortion. He concurred with the district court’s view that EMTALA doesn’t grant an “unqualified right” for a pregnant woman to have an abortion, noting the act’s equal emphasis on stabilizing all patients.

“The question before the court is whether EMTALA, according to HHS’s Guidance, mandates physicians to provide abortions when that is the necessary stabilizing treatment for an emergency medical condition. It does not. We, therefore, decline to expand the scope of EMTALA,” he continued.

Biden Reacts to Supreme Court’s Decision

“Today’s Supreme Court order allows Idaho’s extreme abortion ban to go back into effect and denies women critical emergency abortion care required by federal law,” Biden stated.

“The overturning of Roe v. Wade has enabled Republican elected officials to pursue dangerous abortion bans like this one that continue to jeopardize women’s health, force them to travel out of state for care, and make it harder for doctors to provide care, including in an emergency.”

A Threat to Doctor-Patient Care?

“These bans are also forcing doctors to leave Idaho and other states because of laws that interfere with their ability to care for their patients. This should never happen in America,” the Democratic President said in a Jan. 5 statement.

“The Vice President and I believe that health care decisions should be made by women and their doctors, not politicians. We will continue to defend a woman’s ability to access emergency care under federal law.”

Biden Sounds Alarm on Abortion Rights

In his comments, Biden emphasized the high stakes of this ongoing case for women across the U.S. He called on Congress to promptly restore the protections afforded by Roe v. Wade to guarantee healthcare access for women in all states.

Idaho Attorney General Raúl Labrador strongly approved the Supreme Court’s decision, emphasizing that the federal government’s stance has been “wrong” from the start.

Labrador pointed out that federal law does not override Idaho’s Defense of Life Act, highlighting the shared objective of EMTALA and Idaho’s law to “save the lives of all women and their unborn children. 

He went on, “Today, the Supreme Court’s decision is a big step in stopping the administration’s lawless overreach. The people of Idaho have spoken with clarity on the issue of life.”

Biden’s Medicare Approach Questioned

Officials in Idaho have criticized President Joe Biden’s approach, alleging he is reinterpreting the Medicare law into a “federal super-statute” concerning abortion. 

In contrast, the Justice Department asserts that their guidance only serves to clarify current federal law, which federal authorities believe takes precedence over the state-level abortion bans established last year.

Women facing serious pregnancy complications like sepsis, uncontrolled bleeding, kidney failure, and infertility risks may not be protected by the mother’s life exceptions in abortion laws. While Idaho’s position is backed by twenty conservative states with strict abortion bans, the scope of the Biden administration’s guidance extends beyond these states.

Recently, a federal appeals court in California temporarily supported the Biden administration, stopping the enforcement of contentious aspects of Idaho’s law.
