Potential Move to Disqualify Judge Cannon in Trump Documents Case for Favoring Former President Appeal

The possibility is being weighed that prosecutors in the case of Former President Donald Trump’s classified documents might seek the disqualification of Judge Aileen Cannon following her decision to grant the defense access to specific unredacted classified documents.

Trump’s legal team sought access to numerous classified documents in full, a request opposed by Special Counsel Jack Smith due to potential interference with ongoing investigations.

Judge Cannon on Tuesday, favoring Trump, criticized the special counsel’s lack of detailed objections to the document disclosure, emphasizing the absence of a clear explanation or how the integrity of ongoing investigations might be compromised.

Cannon, appointed by Trump to the U.S. District Court for the Southern District of Florida and taking her position in November 2020, has stirred controversy and discussions about her potential removal due to her decision to delay the pre-trial proceedings, a tactic that could decelerate the case’s progress.

Ted Spaulding, an Atlanta-based trial attorney, spoke to Newsweek before Judge Cannon’s verdict, indicating that while approval of Trump’s request could lead to attempts to challenge the judge, he believed these attempts would likely not succeed.

“Certainly, it could lead to a motion by the prosecution to have the judge removed from the case since it appears the prosecution has already hinted at such a potential filing,” he remarked.

Spaulding stated that he would find it unexpected for the judge to be removed merely for delaying the case. He explained that typically, removals occur due to conflicts of interest or serious misconduct.

The lawyer also noted that procedural rules across states generally allow judges a lot of discretion in managing discovery and case deadlines.

Roger Parloff, senior editor at Lawfare, anticipated before the verdict’s announcement that a decision favoring Trump could prompt the prosecution to file an interlocutory appeal due to perceptions of Judge Cannon showing undue favoritism towards the defense.

Parloff cited section four of the Classified Information Procedures Act (CIPA). This section permits the United States to omit certain classified information from documents slated for discovery by the defendant or to replace the classified documents with a summary of the information contained within.
