A legal expert, Anthony Michael Kreis, has observed a reduction in the probability of Fulton County District Attorney Fani Willis being disqualified from prosecuting former President Donald Trump’s Georgia election interference case.
Case Overview
Fani Willis spearheaded the indictment of the former president and 18 others, accused of plotting to reverse Georgia’s 2020 election outcome, favoring Joe Biden.
Political Bias
Despite Trump’s denial of the charges and accusations of political bias, the case proceeds, with him as the Republican Party’s leading candidate for the 2024 election.
Disqualification Attempt
A challenge to disqualify Willis was launched by Michael Roman, a former Trump campaign official, alleging Willis benefited financially from an “improper, clandestine personal relationship” with Nathan Wade, a lawyer she hired to help lead the investigation.
Racially Charged Attacks
The DA previously attributed the attacks to her and Wade as racially charged, given that he was the only Black person on her team for the Trump case.
“Personal Relationship”
However, in a filing on Friday, she acknowledged a “personal relationship” between her and Wade. Willis clarified that their relationship has never entailed any direct or indirect financial benefit.
Case Dismiss Request
She strongly denounced the allegations as “sensational” and requested that a judge dismiss the conflict of interest claims against her.
No Conflict of Interest
In her filing, she stated, “To be absolutely clear, the personal relationship between Special Prosecutor Wade and District Attorney Willis has never involved direct or indirect financial benefit to District Attorney Willi.”
No Shared Accounts
The filing also noted that “They have no joint or shared accounts, and there ‘is not now and has never been any shared household.”
Supporting Affidavit
The filing includes an affidavit from Wade that supports Willis and states that the relationship with Willis began after his appointment, not before.
Clarification on Relationship
Wade’s affidavit explained, “While professional associates and friends since 2019, there was no personal relationship between District Attorney Willis and me prior to or at the time of my appointment as special prosecutor in 2021. In 2022, District Attorney Willis and I developed a personal relationship in addition to our professional association and friendship.”
Lower Fee & Safety Concerns
Wade also mentioned that he is working on the case for a reduced fee compared to his standard hourly rate because other lawyers expressed reluctance due to concerns related to violent rhetoric and potential safety issues for their families.
Financial Independence
He said, “The District Attorney received no funds or personal financial gain from my position as Special Prosecutor. The District Attorney and I are both financially independent professionals; expenses for personal travel were roughly divided equally between us.”
Disqualification Chances
Kreis, on Friday, wrote on X, “The chances of a successful disqualification went from 5% to .05%,”
Legal Perspective
Kreis suggested that the minimal evidence presented in the initial motion now seems completely irrelevant. He anticipates the court, under Judge Scott McAfee, will dismiss the motions after a thorough evaluation.
Court Hearing
A hearing to review Roman’s request for disqualifying Willis is scheduled for February 15.
End of the Matter
Ryan Goodman, former Special Counsel for the U.S. Department of Defense, expressed his reaction to Wade’s affidavit on X, stating, “This should end the matter.” He mentioned that he had previously criticized both Willis and Wade.
Strong Response
Similarly former federal prosecutor Andrew Weissmann expressed that the strength of the new brief, affidavit, and exhibits from Fani Willis could have effectively countered the allegations if released earlier.
Desperate Attempt
Weissmann believes this diminishes the significance of the upcoming February 15 hearing, attributing it to a desperate move by the defendant.
