Tara Reade, who made a sexual assault allegation against then-candidate Joe Biden in 2020, has sued the Department of Justice for alleged misconduct.
$10 million in Damages
An attorney representing Reade on Wednesday submitted a tort claim, seeking $10 million in damages for “infliction of emotional distress and anxiety.”
“FBI operation”
This claim was filed in response to what was characterized as an “FBI operation” carried out after her accusation against Biden was made public.
Breach Of FISA Act
The tort claim asserts violations of Reade’s Fourth Amendment rights, along with breaches of the Foreign Intelligence Surveillance Act (FISA) and state privacy laws.
Twitter Records
Within the tort claim, there was mention of a July 2020 grand jury subpoena sent to Twitter by the US District Court for the Eastern District of California. This subpoena requested all records related to Reade’s Twitter accounts.
Sexual Assault Claim
Reade, who worked as a Biden aide when he served as a U.S. senator from Delaware, has consistently asserted that she was sexually assaulted by Biden in 1993.
Complaint Filed
During Biden’s 2020 presidential campaign, she filed a criminal complaint with the Washington Metropolitan Police Department, accusing him of assaulting her in a Capitol Hill corridor when she was 29 years old. She alleged that he pushed her against a wall and placed his hands under her shirt and skirt.
Harassment Complaint
Reade mentioned she did not report the assault to Biden’s staff but did file a harassment complaint, which led to her dismissal.
According to NPR, people familiar with Reade have confirmed she shared details of the alleged assault with them when it occurred.
“Never Happened”
President Biden vehemently refuted these allegations made by Reade, stating, “Unequivocally it never, never happened.”
Political Asylum
Last year, Reade grabbed headlines when she disclosed that she had relocated to Russia, citing safety concerns and subsequently being granted political asylum.
“I Felt Safe”
At the time, according to the Guardian, she said, “When I got off the plane in Moscow, for the first time in a very long time, I felt safe, and I felt heard and felt respected.”
Seeking Information
In December, Reade’s attorney dispatched a letter to the DOJ Inspector General’s Office, seeking the release of all FBI records pertaining to her and the removal of any associated cases.
No Response
The absence of a response has led to the current tort lawsuit for privacy invasion, emotional distress, and constitutional rights violations.
Claims of Government Weaponization
“The FBI and DOJ has been weaponized by the Biden administration. Instead of trying to get to the truth, and instead of helping me when I went to the FBI, I had death threats,” Reade told Newsweek.
Unlawful Operation
The lawsuit also alleges that FBI Director Christopher Wray illegally and unconstitutionally directed the covert operation that breached privacy and surveillance laws, violated the Fourth Amendment through unconstitutional searches and seizures, and ultimately compelled Reade to seek asylum in Russia due to fear for her life.
Legal Proceedings and Demands
Jonathan Levy, Reade’s attorney, highlighted that the DOJ is given six months to address the lawsuit, as per standard procedure. On behalf of Reade, Levy is pursuing records held by the FBI, DOJ, and other entities, including the Monterey County District Attorney’s Office, Antioch University, the Department of Homeland Security, and the National Security Agency.
“Two-Tiered Justice System”
Levy, in a statement said, “The United States should not have a two-tiered justice system. If President Trump and Mr. Giuliani can be assessed tens of millions in damages for their words; a weaponized FBI that seeks to silence, intimidate and eliminate Joe Biden’s victim, Tara Reade, must also be held accountable.”
Advocacy for Whistleblower Rights
Levy and Reade are establishing an international commission named Justice for All, aimed at advocating for whistleblower rights globally.
Shift Towards Authoritarianism
Reade emphasizes her legal actions and public statements are in solidarity with those silenced, critiquing the U.S.’s shift towards authoritarianism and the Democratic Party’s evolution towards totalitarianism.
