Jonathan Turley, an attorney and legal commentator, cautioned on Friday that Georgia’s courts might consider legal action against Fulton County District Attorney Fani Willis due to recently uncovered evidence.
Relationship Under Scrutiny

Fani Willis, alongside prosecutor Nathan Wade, whom she appointed in 2021 to spearhead the racketeering lawsuit against Donald Trump, is under examination due to their past romantic relationship, which concluded in the summer of 2023.
Case Background

Fani and Wade are prosecuting former President Donald Trump and 18 others for allegedly attempting to disrupt Joe Biden’s 2020 victory in Georgia,
Trump’s Denial

Trump has rebuffed all allegations, suggesting the case is a political maneuver against him because he is the frontrunner for the GOP presidential nomination in the upcoming November election.
Conflict of Interest

Michael Roman, a former Trump campaign aide and co-defendant, has alleged a personal connection between Willis and Wade, seeking to invalidate their roles and dismiss the charges against him due to a conflict of interest. Roman has also pleaded not guilty in the case against him.
Case Hearings

Judge Scott McAfee, presiding over the case, conducted a series of hearings last week to assess the potential disqualification of Willis and her office from the case.
“It is a Lie”

During her testimony, Willis was questioned about whether Wade had ever visited her home. In response, Willis stated, “So let’s be clear ’cause you lied in this” while holding up court documents. “It is a lie! It is a lie!”
Pre-hiring Visits

However, cellphone data presented in a court filing on Friday by attorneys representing Trump revealed that Wade made dozens of trips to Willis’ home in her neighborhood in Hapeville, Georgia, before he was officially hired.
Testimony Contradiction

This filing contradicts Wade’s testimony last week, where he claimed he had visited Willis’ home no more than 10 times before 2021, as reported by the Atlanta Journal-Constitution.
Overnight Visits

Willis and Wade testified last week that they never spent the night together at her Hapeville condo. However, the cellphone data indicates that Wade visited her residence late at night and left early the following morning on two separate occasions.
Another Challenge

The data provided by Trump’s attorneys presents another challenge to the timeline offered by Willis, as both she and Wade testified under oath that their relationship did not begin until 2022 after Wade was hired.
Calls & Messages

An affidavit from investigator Charles Mittelstadt, included in Friday’s court filing, revealed that Willis and Wade communicated over 2,000 times via phone calls and exchanged nearly 12,000 text messages during the first 11 months of 2021, according to CellHawk, the tool used by Mittelstadt.
Waiting for Response

In response to this affidavit by Mittelstad, Jonathan Turley said, “We are still awaiting a response from Willis so this is only one side. However, it could put Willis’s combative testimony into sharp relief as she declared ‘It’s a lie. It’s a lie’ on the stand.”
Potential Consequences

“If the court believes that Willis and Wade lied on the stand, he could refer the matter for possible prosecution…by some other office. He could also consider a referral to the bar,” He stated. “Once again, the insistence on Willis and Wade that they remain in the case is troubling,”
Conflicts of Interest

In a subsequent post, Turley highlighted the escalating concerns of impropriety and potential conflicts of interest surrounding the case.
Case Integrity Questioned

He pointed out that the continued involvement of the prosecutors not only casts a shadow over the integrity of the legal proceedings but also tarnishes the reputation of their office.
Concerns Magnified

He said, “While many praised Willis for her combative testimony, it only magnified the concerns for many about the underlying personal motivations and interests in the hiring of Nathan Wade.”
“Step Aside”

Turley told Newsweek on Saturday that Willis and Wade should “step aside” from Trump’s Georgia case due to escalating issues.
Personal Interests

He said, “The response of Willis and Wade is now eclipsing the original allegations. They have placed their personal interests before the case and the office… They should clearly step aside.”
Perjury Allegations

Turley added, “However, there are now alleging of false filings with the court and even perjury. The problems are escalating for both prosecutors.”
Upcoming Hearing

Judge McAfee has set a hearing for March 1 to consider the possible disqualification of Willis and Wade.
